Application

These Terms and Conditions will apply to the sale of goods by Saint Teneu Ltd., a Limited Company registered in Scotland under number SC633507, whose registered address is 505 Great Western Road, Glasgow, Scotland, G12 8HN, with email address hi@saintteneu.com.

These Terms and Conditions govern the sale of goods by Us and will form the basis of the Contract between Us and you. Before placing your Order, please ensure that you have read these Terms and Conditions carefully. If you are unsure about any part of these Terms and Conditions, please ask Us for clarification.

By placing an order, you agree to be bound by these Terms and Conditions. Any statements or undertakings made or given at any meetings or in any correspondence shall not amend any of these Conditions of Sale unless made in writing, signed by both Parties and expressly stated to be an amendment to these Conditions of Sale.

1. Definitions

1.1. For the purposes of these Conditions of Sale:

"Us" means Saint Teneu Ltd.

"Goods" means the goods we supply to you of the number and description as set out in the Order.


"Customer" means the person or Party whose order for the Goods is accepted by Us.

"Parties" means Us and the Customer.


"Contract" means the legally binding agreement between the Customer and Us for the supply of the Goods.

2. Specification of Goods

2.1. Be aware that if you are placing an order for Bespoke Goods or Made To Order Goods, we will design and produce these Goods to your specifications, measurements and/or requirements. Please note that due to the Bespoke nature of these Goods, you are waiving your right to cancel this Contract as per the Consumer Rights Act 2015.

2.2. We make every reasonable effort to ensure that the Goods conform to the illustrations, computer-aided models, photographs and descriptions provided to you. We cannot, however, guarantee that all documents will be precisely accurate due to differences in the colour reproduction of electronic displays and the handmade nature of the goods.


2.3. Any geographical or origin provenance claims made in respect of gemstones and metal are made in good faith based on written statements from our suppliers.

2.4. Any measurements provided in respect of gemstones and metal are subject to industry standard tolerances.

2.5. Any Goods or curated selections of diamonds or gemstones described in the Proposal or offered in the Online Shop are available at the time of writing, however there is no guarantee that they will still be available when your Order is placed. In the event that your chosen Goods, diamond or gemstone is no longer available, we will inform you and provide you with alternative options.

2.6. The Goods will be free from defects in material and workmanship. Any visible defects in finished gemstones will be made clear to in photographs and accepted by you at the time of purchase.

2.7. It is your responsibility to ensure that any information that you provide to Us is correct, accurate and complete. We cannot accept any liability due to incorrect information provided by you.

2.8. In particular, it is your responsibility to ensure that the finger size that you provide to Us is correct. We will provide information and ring sizing apparatus if required in order for you to decide the correct size according to your comfort.

3. Price & Payment

3.1. Design consultations for Bespoke Goods are free of charge. Following the completion of your Bespoke Design Questionnaire and subsequent consultations, a concept design will be produced and provided to you in your Bespoke Design Proposal.

3.2. Your Order for Bespoke Goods commences upon approval of the Proposal, acceptance of these Terms & Conditions, and payment of an initial 50% deposit.

3.3. Deposits are non-refundable and will be deducted from the final balance due.

3.4. The initial deposit is typically used to proceed to detailed CAD modelling (if applicable), secure your chosen gemstones (if applicable) and begin manufacture.

3.5. Up to two design iterations are included as part of our CAD service, and any further design changes shall be billed on a time-spent basis.

3.5. Payment of the final balance shall fall due upon completion of work and all payments for Goods must be made in advance of despatch.

3.7. Unless otherwise agreed in writing, payment shall be made in pounds sterling 
within thirty days of receipt of an invoice from Us claiming such payment.

3.8. Quotations are valid for 14 days from the date of issue.

3.9. All Prices include UK delivery. Non-UK delivery may be possible and is subject to a separate quotation upon request.

3.10. Payment is handled by secure third-party services (Dubsado, Stripe and PayPal) unless requested otherwise, to guarantee your protection.

4. Delivery

4.1. We will provide you with an estimated delivery date at the time of order. Please note that for Goods which are Bespoke or Made To Order, delivery timescales may vary and delivery dates are provided on a best-estimate basis. Unless agreed otherwise, the Goods will be delivered without undue delay and in any case no later than 12 weeks after the date on which the Contract is formed.

4.2. Unless agreed otherwise, Goods shall be presented in a presentation box along with any gemstone documentation, and despatched in discreet outer packaging.

4.3. Goods shall be despatched via Royal Mail Special Delivery Guaranteed. Delivery will be deemed to be complete when the Goods have been delivered to the delivery address indicated in your Order.

4.4. The responsibility for the Goods remains with Us until delivery is complete, at which point it will pass to you.

5. Alterations & RETURN OF Goods

5.1. If at any time after placing your Order you wish to make changes to your Order, We will accept these at Our discretion and if We are reasonably able to accommodate your request without additional work.

5.2. If your Order is changed, We will inform you of any change to the Price in writing via email and a Contract Amendment.

5.3. We will only accept an Order cancellation for Bespoke Goods if We have not yet begun making the Goods. In this case, any Deposit paid will be non-refundable.

5.4. If you should require Bespoke Goods to be resized, we offer 1 complimentary resize within 12 months of the date of receipt of the Goods, provided that the change in size is no more than 2 UK sizes in either direction.

5.5. If resizing of greater than 2 UK sizes is required, the Bespoke Goods may need to be remade and in this case a proposal for the work will be provided to you.

5.6. In some instances, Bespoke Goods can not be easily resized. This will be made clear in the Proposal and typically applies to Goods which are engraved, complex, eternity set, enamelled or patterned.

5.7. Alterations are undertaken immediately. Delivery timescales are provided on a best estimate basis, and are typically 7-10 days from receipt of Goods but may vary.

5.8. Please inform Us of your intention to return Goods for alteration, as without prior agreement we cannot be held responsible for loss or damage to your property. You are responsible for your property up to the point of delivery to us and we recommend use of an insured, tracked and signed-for delivery method.

5.9. Goods which are not Bespoke, Made To Order or altered to your requirements, may be returned within 30 days in their original condition and packaging for a full refund.

6. Warranty

6.1. We offer a 12-month warranty on workmanship, which commences from the date of receipt of the Goods.

6.2. This warranty does not apply to deliberate damage, accidental damage, damage through normal wear and tear or damage caused by third-party repairs or alterations.

6.3 Bespoke Goods are designed, produced and inspected with extreme care prior to despatch and therefore we cannot be held responsible for the loss of a precious stone unless in the event of a manufacturing defect. The settings of diamonds are subject to wear and tear and therefore should be inspected by a reputable jeweller at least every 12 months, with repairs undertaken as recommended.

7. Faulty, Damaged or Incorrect Goods

7.1. If you should receive Goods which are defective, damaged or not what you ordered, please contact us within 7 days to inform Us of the fault and to arrange for a refund or repair. If you have not exercised this right of rejection within the said 7-day period, the Goods shall be deemed to have been accepted.

7.2. Please note that if the Goods are incorrect as a result of your provision of incorrect information, rather than them not matching Our description as provided and accepted by you at the time of order placement, you will not be able to return those Goods.

8. Donor Jewellery

8.1. If you have agreed to provide us with your own jewellery, precious metal or precious stones as an input to a bespoke project, the following applies:

8.2. Our assessment and description of your items provided in the Proposal will be solely for the purpose of identification of your property and not as a determination of its value, age, weight, dimensions, nor the identity or fineness of any stone or metal it contains. No appraisal shall be provided by Us, though a professional appraisal can be sought at an additional cost if requested.

8.3. By agreeing to the Contract you understand it will be necessary to deconstruct any donor jewellery provided to us. This is carried out at your own risk and you agree that Saint Teneu Ltd shall not be responsible for the condition of nor any damage to your gemstones and jewellery as a consequence of this process.

8.4. By agreeing to the Contract you understand that it is possible that flaws, cracks or chips in your gemstones may be revealed as a consequence of this process. You understand that even with reasonable care, breakage or other damage may occur during subsequent re-setting of your gemstones and shall be carried out at your own risk.

8.5. Any unused gemstones or gold ingot belonging to you will be returned to you in their loose, unfinished state.

9. Digital Marketing

9.1 All Goods will be photographed prior to despatch and images may be shared on our website and social media accounts. If you would prefer Us not to share these images, please inform Us of this when placing your Order. If your Order is a special gift and you would prefer Us to delay posting images online, please make us aware of this at the time of payment.

9.2. Any photographs you choose to share with Us may be shared on our website and social media accounts. If you would prefer Us not to share these images, please inform Us of this when sharing them with Us.

9.3. Any words you choose to share with Us as part of a testimonial or review may be shared on our website and social media accounts. If you would prefer Us not to share these words, please inform Us of this when sharing them with Us.

10. Copyright

10.1. All content including images, illustrations, designs, CAD files, photographs, text and branding that are part of any proposal or this website are protected by copyright and are the property of Saint Teneu Ltd and/or our manufacturing partners. All rights in such content are expressly reserved to Saint Teneu Ltd. Copying or republication of this content in whole or part is strictly prohibited.

10.2. In accepting a Contract for the supply of the Goods, the Saint Teneu Ltd shall not, by implication or otherwise, be deemed to have granted any free rights of use or licence whatsoever in or to any intellectual property relating to the Goods to be supplied under the said Contract.

11. Legal Governance

11.1. This Agreement shall be governed by and construed in accordance with Scots Law and the parties submit to the non-exclusive jurisdiction of the Scottish Courts.

12. Our Liability

12.1. Nothing in these terms and conditions shall operate to exclude liability for fraudulent misrepresentation or for death or personal injury caused by our negligence or any other liability which cannot be excluded or limited by the applicable law.

12.2. Saint Teneu Ltd will not incur any liability arising out of any delay in delivery or other performance hereunder due to a "Force Majeure". A "Force Majeure" is defined as any circumstance beyond the reasonable control of Saint Teneu Ltd including, but not limited to, industrial disputes, fire, flood, earthquake, currency restriction, shortage of transport, general shortage of material or power or fuel, epidemic, quarantine, Acts of God or nature, riots, mutinies, civil commotion, war or warlike operations, sabotage or any acts of the United Kingdom Government and Departments or Courts thereof. An extension of time for delivery or other performance by the Company shall be granted for a period equal to the duration of the delay caused by the Force Majeure circumstance.

12.3. This Contract contains the complete and entire understanding between the Parties on the subject matter of this Contract and supersedes all previous discussions, proposals, understandings or agreements, oral or written, relating to such subject matter provided that nothing in this clause shall exclude any liability for fraudulent misrepresentation.
